The Commission welcomes the judgement of the European Court of Justice. The Court clearly states that Germany, in its telecoms law of 2007, failed to transpose correctly the EU telecoms rules when exempting new markets in the sector from regulation.
The judgment confirms and underlines the key principle of the EU telecoms rules and of EU telecoms policy of the past 5 years.
To try to achieve more investment on the telecoms market by a relaxation of regulation of dominant telecoms operators or even “regulatory holidays” is not compatible with EU telecoms law.
Under EU telecoms law, any assessment of the state of competition and of the need for regulation must be based on a solid,; independent analysis by the national regulatory authority. It also must follow the EU consultation procedure including the European Commission and other national regulators. These legal principles cannot be bypassed or restricted by national legislation.
This judgment is an important precedent for telecoms regulation across Europe. The judgment will help the European Commission and national regulatory authorities to promote, independently of political pressure, effective competition on the telecoms markets, bringing about more consumer choice and more investment.
The judgment confirms the Commission’s approach that competition is the best instrument to bring about investment in high-speed broadband networks; and not a friendlier attitude to dominant telecoms operators.
