Silicon valley, La macchina della persuasione. (ed il “diritto allo scraping” di Linked In)

In realtà si può contrastare, aumentando la concorrenza che non sia solo PER il mercato ma che sia anche NEL mercato.
Oggi  nessuno fa concorrenza ai market leader perchè gli spazi sono chiusi. Si cerca di colonizzare spazietti residui.
E’ una decisione politica, in ultima analisi.
Basterebbe affermare, come rimedi alla concentrazione di potere, il diritto dell’utente a portare i suoi dati e l’obbligo degli intermediari ad interconnettersi ed interoperare. Come abbiamo fatto quando abbiamo voluto introdurre concorrenza nelle TLC.
Questo consentirebbe di frammentare il controllo. E cosi’ come il numero telefonico è “diventato nostro” con un provvedimento fatto per ragioni di concorrenza, anche i dati “diventerebbero nostri”.
Le teconologie per consentirlo, ormai ci sono (penso in primo luogo ad IPFS)
Molte forze puntano in questa direzione.

Questo giudice sta cercando di andare nella direzione di maggiore conccorenza (anche se, coerentemente con la visione USA, non si pone il problema del fato che l’utente abia caricato su Linked In i propri dati per darli solo a Linked In e non a terzi).
Qualcuno inizierà anche ad esaminare le pratiche di innovazione fate per escludere competitor (sia tecnica che commerciale che giuridica che …)
Una pratica di innovazione predatoria è molto difficile da riconoscere…
