Ci sarebbe stato ad oggi un solo caso in tribunale per una azienda che ha dichiarato falsamente di soddisfare le norme sulla privacy europee, ma senza sanzione.
Le autorita’ tedesche chiedono un incontro per risolvere la situazione.

data protection Safe Harbour agreement and to agree on a resolution on
this
matter.The concern of the German DPAs is motivated by report published by Galexia, a US consulting company, which found that more than 200 companies claimed to have joined the Safe Harbour Agreement without having done so. It also showed that only about 350 companies complied with the minimal requirements and that, by December 2008, in 10 years of application of the agreement, there has been only a court case for not fulfilling the requirements, without any sanctions for the infringing company.
Te ne do atto: sei stato il primo a dirlo che le sanzioni antitrust erano ridicole.
Ora il punto non è il quantum (quote di fatturato) ma il qualis (ossia Catricalà preferisce gli impegni).

ma gli impegni de che? Questo garante straparla, sarebbe come se i vigili non potessero fare multe ma solo rccogliere “impegni” degli automobilisti di non parecheggiare più in divieto di sosta o di superare il limite di velocità.
Ma è una cosa seria?
Cosa succede ad un’azienda se non rispetta un “impegno vincolante”?
Il DDL presentato nella legislatura ora al termine dalla Sen Rame che prevedeva l’inasprimento delle sanzioni e la possibilità di rapportarle, come anche richiesto dall’Antitrust, in funzione al fatturato, dovrà trovare un nuovo volenteroso “dipendente” che voglia riproporlo ma dubito che riuscirà a trovarlo.
